Licensing a Photograph?

Looks like we have a few photographers and artists in our midst so here's a place to talk about all photography, art, and related subjects.

Licensing a Photograph?

Postby Savannah_Alan » Wed 4 Oct 2006 16:47 GMT

I've recently had somebody ask to use one of my photographs on a postcard.

I've never sold a photograph before. I basically just want to guard against him re-selling the shot.
Does anybody have any idea what sort of licensing structure I should use and even possibly a license agreement that I could "plagiarise"?

Alan.

Do a search for 'creative commons'. This is an image equivalent of Open Source software licensing. Quite a lot of the images on sites like flickr.com now use this form of licence. It insists on the user reproducing the image as is (not publishing an image derived from it) unless you give permission for him/her to do so, and not reselling the work for profit. You retain copyright, and can make other agreements (such as selling a licence to someone for a specific use, like making postcards for resale).

The majority of images are now sold 'royalty free', i.e. a one-time charge which allows the licencee to amke whatever use he likes of th eimage. The alternative, of charging different amounts for different uses, is harder to sell these days, but pays big dollars if someone uses your image on a huge roadside advertising campaign.

Here it is. I see that there is also a version that allows people to take parts of your image to make a collage.

Thanks Mike. I thought you'd be the one coming through for me  .

I'll take a look this evening.
