Does Survivor Benefit Count As Income for an I-864?

Postby Damian P » Sat 21 Mar 2009 14:08 GMT

I just wondered if anyone knew whether or not social security survivor benefit can be used as income to sponsor an immigrant.

My wife to be (the USC) and I had to use a co-sponsor for the I-134 in order to get my K-1 visa, but since then, her ex-husband suddenly and unexpectedly passed away. As such, her two kids are now entitled to survivor benefit, which equates to a tidy sum each month, and as such, we could can the co-sponsor if we were allowed to use it as income for the I-864.

I'd like to make clear at this point that I've no intention of living off a cent of that money; it'd just be a very convenient way of dotting the 'I's and crossing the 'T's with USCIS, that's all.
